Article 39 of the United Nations Charter designates the UN Security Council as the only tribunal that may determine UN human rights violations. The onset of the Cold War soon after the UDHR was conceived brought to the fore divisions over the inclusion of both economic and social rights and civil and political rights in the declaration. Capitalist states tended to place strong emphasis on civil and political rights , and were reluctant to include economic and social rights . Socialist states placed much greater importance on economic and social rights and argued strongly for their inclusion. These rights were, not coincidentally, the rights set out in the US constitution. The Soviets argued that human rights consisted of social or economic rights – the rights to work, to healthcare, and to education.
